Terms of Service

Welcome to the tolomu.com website and platform (the "Service").

The Service is operated by Timechain LLC, a limited liability company organized under the laws of the State of Wyoming, United States ("Tolomu", "we", "us").

By accessing or using the Service, you agree to be bound by these Terms of Service (the "Terms"). If you do not agree with them, you must not use the Service.

Service Description

Tolomu is a software platform that helps wellness and fitness studios ("Studios") manage their schedules, classes, members, bookings, plans, and attendance, and that allows people ("Members") to discover Studios and book classes with them.

Tolomu provides software only. Studios are independent businesses that are not owned, operated, controlled, or supervised by Tolomu. Tolomu is not a party to the relationship between Studios and Members, does not provide the classes or services offered by Studios, and does not employ or certify their instructors.

Accounts and Registration

To use certain features of the Service, you must create an account and provide truthful and up-to-date information.

You are responsible for maintaining the confidentiality of your account and login codes, and for all activity that occurs under your account.

You must be at least 18 years old to create an account. Minors may participate in Studio activities only under the responsibility and with the consent of a parent or legal guardian, according to each Studio's own policies.

Studios Are Independent Businesses

Each Studio is solely responsible for:

The content it publishes on the Service, including its schedule, class descriptions, prices, and photos
The quality, safety, and legality of the classes and services it provides
The qualifications and conduct of its instructors and staff
The condition and safety of its facilities and equipment
Maintaining any licenses, permits, or insurance required by applicable law
Its own policies, including cancellation, refund, liability waiver, and minor-participation policies

Tolomu does not guarantee the truthfulness, accuracy, or legality of the information published by Studios, nor the quality or safety of their services.

Member Information Entered by Studios

Studios may record information about their members in the Service, such as contact details, plans, attendance, and payment logs.

Each Studio is responsible for having the necessary consent or legal basis to enter and manage that information, and for keeping it accurate. Tolomu processes that information to provide the Service to the Studio, as described in our Privacy Policy.

Bookings, Cancellations, and Attendance

When a Member books a class through the Service, the resulting agreement is solely between the Member and the Studio.

Cancellation, no-show, late-arrival, and refund policies are set by each Studio. Tolomu does not guarantee that a booked class will take place, that space will be available, or that a Studio will honor a booking.

Attendance and payment records kept in the Service are entered and managed by Studios for their own record keeping. Tolomu is not responsible for their accuracy.

Physical Activity and Assumption of Risk

Classes and services offered by Studios may involve physical exertion and carry an inherent risk of injury.

By booking or attending a class, you acknowledge that you participate voluntarily and at your own risk, and that you are responsible for evaluating your own physical condition. We recommend consulting a physician before starting any exercise program.

Tolomu is not responsible for injuries, health conditions, accidents, or any harm arising from participation in classes or activities provided by Studios. Responsibility for the safety of classes, facilities, and equipment lies solely with each Studio.

Payments Between Members and Studios

Payments for classes, plans, memberships, or any other Studio service are made directly between the Member and the Studio, outside of the Service, unless expressly stated otherwise.

Tolomu does not process those payments, does not hold funds on behalf of Studios or Members, and is not responsible for pricing, billing, refunds, or payment disputes between Members and Studios.

Tolomu Subscriptions for Studios

Tolomu may offer paid subscription plans that give Studios access to additional features.

Subscription payments are processed through external payment providers. Tolomu does not store credit or debit card information.
Prices, features, and availability of plans may change at any time. Changes do not affect periods already paid.
Free trials, when offered, are subject to the conditions stated at the time of sign-up.
Subscriptions can be canceled at any time. Unless required by applicable law, payments already made are non-refundable, and access continues until the end of the paid period.

Acceptable Use

By using the Service, you agree to:

Not use the Service for illegal or unauthorized purposes
Not post false, misleading, or offensive content
Not interfere with the operation of the Service
Not attempt to access accounts or data that do not belong to you
Not use automated tools, bots, or web scrapers to extract information from the Service

Content and Intellectual Property

The Service, including its software, design, brand, and logos, is the property of Tolomu and is protected by applicable intellectual property laws.

Studios and Members retain ownership of the content they submit to the Service and grant Tolomu a non-exclusive license to host, display, and distribute that content as needed to operate the Service.

Account Suspension and Termination

Tolomu reserves the right to:

Deactivate or delete accounts
Remove content or public Studio pages
Restrict access to the Service

These actions may be taken at any time and without prior notice, especially in cases of misuse of the Service or violation of these Terms.

Service Availability

The Service may be modified, suspended, or discontinued in whole or in part at any time, with or without prior notice.

Tolomu does not guarantee that the Service will be available uninterrupted or free of errors.

Disclaimer of Warranties

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, to the maximum extent permitted by applicable law.

Limitation of Liability

To the maximum extent permitted by applicable law, Tolomu is not responsible for:

Losses, damages, or disputes arising from the relationship between Members and Studios
Injuries or harm arising from participation in classes or activities provided by Studios
Incorrect or misleading information published by Studios or other users
Damages resulting from the use of, or inability to use, the Service

To the maximum extent permitted by applicable law, Tolomu's total aggregate liability for any claim related to the Service will not exceed the amounts you paid to Tolomu during the 12 months preceding the event giving rise to the claim, or 100 US dollars if you have not paid Tolomu any amounts.

Nothing in these Terms limits rights that consumers may have under mandatory local law.

Indemnification

You agree to indemnify and hold Tolomu harmless from claims by third parties arising from your use of the Service in violation of these Terms, including, in the case of Studios, claims by their members related to the services the Studio provides or the member information the Studio manages.

Governing Law

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict-of-law rules. Any dispute related to these Terms will be submitted to the competent courts of the State of Wyoming, except where mandatory consumer-protection law provides otherwise.

Modifications to the Terms

Tolomu reserves the right to modify these Terms at any time. Modifications will take effect once published on the Service. Continued use of the Service after changes are published constitutes acceptance of the updated Terms.
